Article 1. General
In these terms and conditions, the following terms are used with the following meanings, unless expressly stated otherwise:
RondvaartLeiden en omstreken B.V.:
The user of these terms and conditions. RondvaartLeiden can also be referred to as the lessor of the sloops.
Renter:
The person who enters into an agreement with RondvaartLeiden or to whom RondvaartLeiden has issued a quote to which these terms and conditions apply.
These terms and conditions apply to all (rental) agreements of RondvaartLeiden regarding the rental of sloops for up to 8 people. By entering into an agreement in which these terms and conditions are referenced without comment, the Renter agrees to their application.
Deviation from these terms and conditions is only possible if the parties have expressly agreed to this in writing beforehand. The application of any terms and conditions of the Renter is explicitly rejected.
Situations not covered by these terms and conditions, or where ambiguity exists, will be assessed in the spirit and purpose of these conditions. RondvaartLeiden reserves the right to change or supplement these conditions.
Article 2. General Rules
- RondvaartLeiden rents out sloops. The Renter must adhere to these conditions at all times and ensure that all passengers do the same.
- In the event of a violation of the rules, RondvaartLeiden reserves the right to terminate the agreement immediately, without refund of any amounts already paid.
Types of registered users:
- Registered user: By registering, the Renter can easily rent a sloop at the regular rates.
Opening hours:
The vessels can be rented during regular opening hours, as stated on the RondvaartLeiden website.
General rules for sloops:
- The driver must be 21 years or older.
- Each sloop is suitable for a maximum of 8 people.
- It is forbidden to operate a sloop under the influence of alcohol or drugs.
- Speakers are not allowed.
- The Renter may not leave the sloop unattended.
Sailing rules:
- Safety comes first; do not take risks.
- Always stay to starboard and respect the maximum speed.
- Commercial shipping always has priority.
- Respect the privacy of residents and prevent nuisance.
- Life-saving equipment must be present and ready for use.
Article 3. Opening
- The sailing season runs from April 1st to October 31st.
Article 4. Rental Period
- The rental period begins at the pre-arranged time.
- Extension of the rental period is only possible subject to availability and after telephone contact with RondvaartLeiden.
- In the event of late return, a double hourly rate may be charged.
- The sloop must be returned clean and free of trash.
- The sloop must be returned correctly moored.
Article 5. Pets
- Dogs are allowed provided they behave well and have their own blanket to protect the cushions.
- Any fouling or damage can be recovered from the Renter.
Article 6. Obligations of Renter and RondvaartLeiden
- RondvaartLeiden provides a sloop in good condition and equipped with the correct safety equipment.
- The Renter remains responsible at all times and may not hand over the sloop to third parties.
- The Renter follows all instructions from RondvaartLeiden.
- The Renter is liable for damage caused by themselves or fellow passengers.
Article 7. Deposit and Payment
- No security deposit will be charged.
- Payment must be made prior to the rental period.
Article 8. Damage and Liability
- Vessels are insured (Third Party + Hull coverage), with a deductible of €500 per claim.
- The Renter is liable for damage that occurs during the rental period, unless there is intent or gross negligence on the part of the lessor.
- In case of reckless behavior or violation of rules, (partial) coverage may lapse and the renter can be held fully liable.
- The lessor is not liable for damage or loss, unless there is intent or gross negligence on the part of the lessor, including:
personal injury
loss or theft of property
consequential damage
- Minors are the responsibility of parents or supervisors.
- RondvaartLeiden is not liable for personal damage unless there is intent or gross negligence.
Article 9. Cancellations
- Free cancellation is possible until 10:00 AM on the day itself.
- Rescheduling to another date free of charge is possible until 10:00 AM on the day of the booking.
- After that, the right to a refund expires, even in the event of weather conditions.
- In the event of a KNMI weather alarm (code red), the boat trip can be rescheduled free of charge.
Article 10. Force Majeure
- RondvaartLeiden is not liable in case of force majeure, which also includes strikes or unforeseen circumstances.
- In case of force majeure, obligations can be temporarily suspended or the agreement can be dissolved after two months.
Article 11. Complaints and Disputes
- Complaints must be submitted in writing within a reasonable time.
- Dutch law applies; the competent court in Leiden has exclusive jurisdiction.
Article 12. Gift Cards and Vouchers
- Gift cards and vouchers cannot be exchanged for cash.
- Reservations made with gift cards or vouchers cannot be canceled, but can often be moved to another date.
