Terms and Conditions – Rondvaart Leiden en omstreken B.V.

Article 1. Definitions

In these terms and conditions, the following definitions apply:

RondvaartLeiden en omstreken B.V.
The private limited company offering city tours, boating packages, and boat rentals, hereinafter referred to as: “RondvaartLeiden”.

Client / Renter
The natural or legal person who enters into an agreement with RondvaartLeiden.

Skipper
Employee of RondvaartLeiden and designated operator of the vessel.

City tour with skipper
A city tour organized by RondvaartLeiden according to a predetermined duration, carried out with a skipper.

Boating package with skipper
An exclusively booked vessel with a skipper for private use, company outings, drinks, dinners, parties, or other arrangements.

Vessel
Any boat, sloop, or other ship made available by RondvaartLeiden.


PART I – GENERAL PROVISIONS

Article 2. Applicability

  1. These terms and conditions apply to all quotes, reservations, agreements, and services of RondvaartLeiden.
  2. Deviations from these terms are only valid if agreed upon in writing.
  3. General terms and conditions of the client are explicitly excluded.
  4. By making a reservation, the client declares to agree with these terms and conditions.

Article 3. Reservations and agreements

  1. An agreement is established as soon as RondvaartLeiden confirms a reservation in writing or electronically.
  2. RondvaartLeiden reserves the right to refuse a reservation without stating reasons.
  3. The client is responsible for providing correct contact and billing details.

Article 4. Payment

  1. Payment must be made according to the term stated on the invoice.
  2. If payment is not made, the client is in default by operation of law.
  3. All judicial and extrajudicial collection costs are for the account of the client.

Article 5. Safety and rules of conduct

  1. Instructions from the skipper and employees of RondvaartLeiden must always be followed immediately.
  2. The maximum number of persons allowed on board must not be exceeded.
  3. RondvaartLeiden reserves the right to refuse persons access to the vessel in case of:
    • excessive alcohol consumption;
    • aggressive behavior;
    • dangerous behavior;
    • disturbance of public order.
  4. Smoking and drug use on board are prohibited.
  5. It is prohibited to damage or take property belonging to RondvaartLeiden.
  6. Passengers enter the vessel at their own risk.

Article 6. Liability

  1. RondvaartLeiden is only liable for direct damage resulting from intent or gross negligence.
  2. RondvaartLeiden is not liable for:
    • loss, theft, or damage of personal belongings;
    • injury caused by the passengers’ own actions;
    • delays due to weather conditions, bridges, locks, or other nautical circumstances.
  3. The liability of RondvaartLeiden is always limited to the invoice amount of the agreement in question.

Article 7. Force Majeure

  1. Force majeure is understood to mean any circumstance beyond the control of RondvaartLeiden that makes the execution of the agreement reasonably impossible.
  2. This includes, among other things:
    • extreme weather;
    • storm;
    • fog;
    • strikes;
    • technical failures;
    • government measures;
    • waterway blockages.
  3. In case of force majeure, RondvaartLeiden has the right to change, reschedule, or cancel the agreement without being liable for damages.

PART II – CITY TOURS WITH SKIPPER

Article 8. City Canal Cruises

  1. City tours take place according to a predetermined schedule, route, and duration.
  2. RondvaartLeiden reserves the right to adjust routes due to safety, crowds, or nautical circumstances.
  3. Departure times must be strictly observed.
  4. In case of late arrival, there is no right to a refund.

Article 9. City Canal Cruise Cancellation

  1. You can cancel or reschedule the city tour with skipper free of charge until 10:00 AM on the day of the booking. After that, cancellation is no longer possible.
  2. If weather conditions according to the KNMI create a dangerous situation, RondvaartLeiden can cancel or reschedule the tour.
  3. In case of cancellation by RondvaartLeiden, the client will receive a refund or an alternative offer.

PART III – BOATING PACKAGES WITH SKIPPER

Article 10. Boating Packages

  1. Boating packages involve exclusive bookings of a vessel with a skipper.
  2. Packages can consist of:
    • drinks;
    • dinners;
    • company outings;
    • private events;
    • group tours.
  3. The content of the package is recorded in the agreement or quote.

Article 11. Number of persons

  1. The maximum allowed number of persons per vessel is:
    • maximum 8 persons on small sloops;
    • or the maximum indicated by RondvaartLeiden.
  2. Exceeding the maximum number of persons is not allowed.

Article 12. Catering and Drinks

  1. Catering and drinks may only be brought on board with prior permission from RondvaartLeiden.
  2. RondvaartLeiden reserves the right to charge corkage or cleaning fees.
  3. Glassware is refused due to safety risks.

Article 13. Cancellation of boating packages

  1. Cancellation by the client:
    • more than 30 days before start: free of charge;
    • 30 to 14 days before start: 50% of the total amount due;
    • 14 to 7 days before start: 75% due;
    • within 7 days before start: 100% due.
  2. Changes in group size must be communicated in writing at least 5 days in advance.
  3. In case of bad weather, RondvaartLeiden will consult with you to find a suitable solution, such as rescheduling or an alternative package.

Article 14. Damage

  1. The client is liable for damage caused by themselves or their guests.
  2. Costs for repair, replacement, or extra cleaning will be charged.

Article 15. Complaints

  1. Complaints must be reported as soon as possible during the execution of the agreement.
  2. Written complaints must be submitted no later than 14 days after the end of the activity.

Article 16. Applicable law

  1. All agreements are exclusively governed by Dutch law.
  2. Disputes will be submitted exclusively to the competent court in The Hague.
